1. Acceptance of Terms
By accessing or using Progressus AI’s website, products, or services, you (“you” or “Customer”) agree to be bound by these Terms & Conditions (“T&C”). If you do not agree with any part of these T&C, you must immediately cease all use of our site and offerings.
2. Modifications to Terms
Progressus AI reserves the right, in its sole discretion, to update, amend or replace these T&C at any time. When we do, we will revise the “Last Updated” date at the top of this page. Your continued use after such changes constitutes your acceptance of the new T&C.
3. Intellectual Property
All content, software, code, graphics, logos, product names, page headers, and images (the “Materials”) on this site are our exclusive property or used with permission. They are protected by copyright, trademark and other intellectual property laws. You may not copy, reproduce, distribute, create derivative works of, publicly display, or otherwise use the Materials in any form or by any means without our express written consent.
4. Limited License & Permitted Use
Subject to your compliance with these T&C, Progressus AI grants you a limited, revocable, non-exclusive license to access and use our site and its features for your personal or internal business purposes only. Any commercial use, resale, sublicensing, or distribution is strictly prohibited.
5. Prohibited Conduct
You agree not to:
Reverse-engineer, decompile, disassemble, or otherwise attempt to derive source code from our products or services;
Modify, adapt, or hack any part of our website or software;
Circumvent or disable any security or technological features;
Use our site, products, or services in any unlawful, harmful, or fraudulent manner.
Commercialize, sell, rent, lease, sublicense, distribute, or otherwise derive revenue from our products or services by any means.
6. User Accounts
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to notify us immediately of any unauthorized use.
7. Order Acceptance & Payment
All orders are subject to acceptance by Progressus AI. We reserve the right to refuse or cancel any order for any reason. Payment is due at the time you place your order. Prices are exclusive of taxes, shipping, and handling, which will be added to your order where applicable.
8. Refunds & Trials
Our one-week, risk-free trial begins on the date of purchase or activation. During your trial, you may cancel for any reason and receive a full refund. After the trial, you have an additional 15 days to request a full refund as detailed in our Refund Policy.
9. Third-Party Links
Our site may contain links to third-party websites. These links are provided solely as a convenience. We do not endorse and are not responsible for the content, privacy policies, or practices of any third-party sites.
10. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROGRESSUS AI PROVIDES ITS PRODUCTS AND SERVICES “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
11. Limitation of Liability
IN NO EVENT SHALL PROGRESSUS AI OR ITS AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE OR OUR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES SHALL NOT EXCEED THE AMOUNTS YOU PAID IN THE 12 MONTHS PRIOR TO THE CLAIM.
12. Indemnification
You agree to defend, indemnify, and hold harmless Progressus AI and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including attorneys’ fees) arising out of your breach of these T&C or your misuse of our site, products, or services.
13. Termination
We may suspend or terminate your access immediately, without prior notice, for any reason, including breach of these T&C. Upon termination, your license to use our site and any services will automatically cease.
14. Governing Law & Jurisdiction
These T&C and any disputes arising out of or relating to them shall be governed by and construed in accordance with the laws of the Republic of Turkey. Any legal action or proceeding arising under these T&C shall be brought exclusively in the courts of Istanbul, Turkey, and you hereby consent to personal jurisdiction and venue therein.
15. Severability
If any provision of these T&C is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
